Ash-Shaikh Muhammad Naasir ud-Deen Al-Albaanee said in his book, Silsilat ul-Ahaadeeth is-Saheehah: <o:p></o:p>
It was narrated from Waathilah bin Al-Asqa' (radhiyallaahu 'anhu) that he said that the Messenger of Allaah (sallallaahu 'alayhi wa sallam) said: <o:p></o:p>
"It is not (permissible) for the woman to use up anything of her wealth except with the permission of her husband." <o:p></o:p>
Saheeh (authentic). As-Saheehah, no. 775. <o:p></o:p>
I (Al-Albaanee) say: This hadeeth, and that which we have alluded to of narrations that have the same meaning, proves that it is not permissible for the woman to use (i.e. spend) her personal wealth except with the permission of her husband. This is from the completeness of the guardianship and authority which our Lord - blessed is He the Exalted - has given him (the husband) over her. However, it is not desired for the husband - if he is a true Muslim - to take advantage of this ruling, thus becoming a tyrant over his wife and preventing her from using her wealth in that which is not harmful to them. This right is very similar to the right of the Waliyy of the girl who is not permitted to marry herself off without the permission of her Waliyy. Thus, if he (the Waliyy) unjustly prevents her from marriage, she takes her matter to the Islaamic judge so that he can give her justice. Likewise is the ruling regarding the wealth of the woman if her husband is oppressive to her and he prevents her from from lawful, legislated spending of her wealth. In such a case, the judge also makes sure she is treated fairly. Therefore, the ruling itself is not the cause of any problem, rather the problem is only due to inappropriate dealing regarding it. So take heed. <o:p></o:p>
